INFORMATION WE COLLECT1.1 Information You Provide DirectlyWe collect information you provide when you create an account, book or perform services, communicate with us, or otherwise interact with the Platform. - Communications you send to Tend. or other users through the Platform1.2 Information We Collect AutomaticallyWhen you use the Platform, we automatically collect certain information, including:- Device information (device type, operating system, unique device identifiers)
- IP address
- Mobile advertising identifiers (such as Apple IDFA or Google AAID)
- Browser type and version
- App usage data, including features accessed, pages viewed, and actions taken
- Log data (access times, pages viewed, links clicked, crash reports)
- Location data, including approximate location based on IP address and, with your permission, precise GPS location data to facilitate service matching1.3 Location InformationWith your consent, we collect precise location data from your mobile device to match Customers with nearby Tend Pros and to facilitate the performance of services. You may disable location permissions in your device settings, but doing so may limit the functionality of the Platform. We collect location data only when the app is in use unless you separately grant permission for background location collection.1.4 Information from Third PartiesWe may receive information about you from third parties, including:- Stripe and other payment processors, for payment verification and fraud prevention
- Identity verification services
- Background check providers (for Tend Pros, where applicable)
- Analytics providers
- Social media platforms, if you choose to connect your account or log in via a third-party service---2. HOW WE USE YOUR INFORMATION2.1 We use the information we collect for the following purposes:- To create and manage your account
- To facilitate bookings and service transactions between Customers and Tend Pros
- To process payments and issue payouts through Stripe
- To communicate with you about your account, bookings, and the Platform
- To contact you outside of the app by phone, email, or SMS when necessary, including for account issues, service disputes, safety concerns, legal matters, or important Platform updates
- To send you promotional communications about the Platform, new features, and offers (you may opt out of promotional communications at any time as described in Section 7)
- To verify your identity and prevent fraud
- To enforce our Terms of Service and this Privacy Policy
- To improve the Platform and develop new features
- To conduct analytics and research to better understand how users interact with the Platform
- To comply with applicable laws, regulations, and legal obligations
- To respond to legal process, law enforcement requests, or government inquiries

For example, when a booking is confirmed, Customers and Tend Pros may receive each other's name, phone number, general location, and other information necessary to perform and receive services.3.2 With Service ProvidersWe share information with third-party vendors and service providers that assist us in operating the Platform, including:- Stripe (payment processing)
- Cloud hosting and infrastructure providers
- Analytics providers
- Customer support tools
- Identity verification and background check services
- Email and SMS communication providersThese service providers are contractually obligated to use your information only as necessary to provide services to us and in accordance with this Privacy Policy.3.3 For Legal ReasonsWe may disclose your information if we believe in good faith that disclosure is necessary to:- Comply with applicable law, regulation, legal process, or government request

This commitment applies to all users of the Platform.---4. PAYMENT INFORMATION4.1 All payment transactions on the Platform are processed by Stripe, Inc. Tend. does not collect or store full credit card numbers, bank account numbers, or other sensitive financial information. Your payment information is subject to Stripe's Privacy Policy, available at stripe.com/privacy.4.2 Tend. stores only limited payment-related information necessary to process transactions, such as the last four digits of a card, card type, and billing address, as provided by Stripe.---5. DATA RETENTION5.1 We retain your personal information for as long as your account is active or as needed to provide you with the Platform's services.5.2 We may retain certain information after account deactivation or deletion as necessary to comply with legal obligations, resolve disputes, enforce agreements, or for legitimate business purposes such as fraud prevention and safety.5.3 When information is no longer needed, we will delete or anonymize it in accordance with our data retention practices.---6. You may opt out of promotional SMS communications by replying STOP to any promotional text message. Please note that even after opting out of promotional communications, we may still send you transactional and account-related communications necessary for the operation of the Platform and your account.7.3 Location DataYou may disable precise location collection by adjusting your device's location settings. Disabling location access may affect the functionality of the Platform, including the ability to match with nearby service providers.7.4 Push NotificationsYou may disable push notifications through your device settings. Disabling push notifications may affect your ability to receive timely booking updates and other important Platform communications.7.5 Do Not TrackSome browsers include a "Do Not Track" feature that signals websites not to track your activity. The Platform does not currently respond to Do Not Track signals, as there is no universal standard for such signals.---8. TEXAS-SPECIFIC PRIVACY RIGHTS8.1 Texas Data Breach Notification. In the event of a security breach that compromises your sensitive personal information, Tend. will notify affected Texas residents as required by the Texas Identity Theft Enforcement and Protection Act, Tex. Bus. & Com. Code § 521.001 et seq. Notification will be provided in the most expedient time possible and without unreasonable delay, consistent with the legitimate needs of law enforcement and measures necessary to determine the scope of the breach and restore the integrity of the data system.8.2 Texas Privacy Act. To the extent required by applicable Texas law, including the Texas Data Privacy and Security Act (TDPSA), Tex. Bus. & Com. Code § 541.001 et seq., Texas residents may have the following rights with respect to their personal data:- The right to confirm whether Tend. is processing your personal data and to access such data
- The right to correct inaccuracies in your personal data
- The right to delete your personal data
- The right to obtain a portable copy of your personal data in a format that allows you to transmit the data to another controller
- The right to opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you8.3 To exercise any of the rights described in Section 8.2, please submit a request to [email protected]. We will respond to verified requests within 45 days as required by applicable law. We may extend this period by an additional 45 days when reasonably necessary, with prior notice.8.4 You may appeal our decision regarding your privacy rights request by contacting us at [email protected] within 30 days of receiving our response. We will respond to your appeal within 60 days as required by applicable law. If your appeal is denied, you may contact the Texas Attorney General at texasattorneygeneral.gov.8.5 Tend. does not sell personal data as defined under the TDPSA.8.6 Tend. does not process personal data for targeted advertising as that term is defined under the TDPSA.8.7 Tend. does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning users.---9. CHILDREN'S PRIVACY9.1 The Platform is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13.
